Federal law and cases express a consistent and deliberate bias in favor of parental control over key educational, medical, and supervisory decisions for children under the age of 18. For example, decisions regarding special education placements, controversial course materials, on-campus administration of medical products, and other similar matters all require parental involvement and consent.
Recent developments in Colorado law and rulemaking, include provisions ostensibly granting children and/or schools unilateral discretion over matters previously reserved for parents. This, conspicuously, includes the sensitive and evolving issue of gender expression. And if further extends to certain medical and mental health services and even medical decisions.
This course will address and clarify the legal framework, offer insights into navigating the conflict of law questions, and provide practitioners a variety of practical types to assist in defending the rights of students, schools, and parents in a quickly evolving legal framework. The course will additionally address related questions regarding state adoption of new and controversial curricular standards which, in the past, were reserved for the discretion of school leaders pursuant to Colorado’s “local control” scheme.
